Decision in the case of Rabone v Pennine Care Trust

In November 2011 the Supreme Court heard the case of Rabone v Pennine Care NHS Trust and handed down a judgment on 8 February 2012. It states that the operational obligation under Article 2 of the Convention, which is a positive duty to take preventative operational measures to safeguard an individual's life in certain circumstances, is owed to voluntary mentally ill hospital patients as well as those detained under the Mental Health Act 1983. The Panel will consider the implications of this judgment in relation to its workstreams on Article 2-compliant investigations and deaths of detained patients.
